These Terms of Service (“Terms”) govern your use of KURO’s services, including purchases made through our physical store (located at 5 Rue Maurice Pasquier, 49100 Angers, France) and our online platform (joyvhq.com, “Website”). By accessing or using our services, you agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy. If you do not agree with any part of these Terms, please do not use our services.

1. Eligibility

To use our services and make purchases, you must:
  • Be at least 18 years of age, or have the consent of a parent or legal guardian (who will be responsible for your use of the services);
  • Provide accurate, complete, and up – to – date information when creating an account (if applicable) or making a purchase;

3. Orders & Purchases

3.1 Order Placement & Acceptance

  • When you place an order (online or in – store), you are making an offer to purchase the selected toys at the listed price. KURO reserves the right to accept or reject your order for any reason, including but not limited to:
    • Errors in product pricing or description (e.g., typos, incorrect stock levels);
    • Suspected fraud or unauthorized payment;
    • Unavailability of the product (due to stock shortages or discontinuance);
  • For online orders, we will send you an order confirmation email once your order is accepted. This email constitutes a binding contract between you and KURO. For in – store orders, the receipt provided at the time of purchase serves as confirmation.

3.2 Pricing & Payment

  • All product prices are displayed in the applicable currency (as indicated on the Website or in – store) and are subject to change without prior notice. However, we will honor the price listed at the time you place your order (provided the order is accepted);
  • You agree to pay the full amount of the order (including any applicable taxes, shipping fees, or other charges) using an accepted payment method (e.g., credit card, debit card, PayPal, or cash for in – store purchases);
  • KURO is not responsible for any additional fees imposed by your payment provider (e.g., foreign transaction fees, overdraft fees);
  • If payment is declined or we are unable to process your payment, your order will be cancelled, and we will notify you promptly (via email for online orders or in – person for in – store orders).

3.3 Stock & Availability

  • Product stock levels are updated regularly on the Website and in – store, but we cannot guarantee that all listed products will be available at the time of purchase. If a product becomes unavailable after your order is placed, we will notify you immediately and offer a refund, replacement (if a similar product is available), or store credit (at your option).

4. Product Information & Warranties

  • KURO makes reasonable efforts to ensure that product descriptions, images, and specifications (e.g., age recommendations, safety features) on the Website and in – store are accurate and up – to – date. However, we do not warrant that all information is error – free, and minor discrepancies may occur (e.g., color variations due to screen display settings);
  • All toys sold by KURO comply with applicable safety standards (e.g., EU CE marking, ASTM International standards for children’s products). Any manufacturer warranties for specific products will be provided to you at the time of purchase (if applicable). KURO’s liability for product defects is governed by our Refund Policy.

5. Intellectual Property

  • All content on the KURO Website (including but not limited to text, images, logos, product designs, trademarks, and software) is the intellectual property of KURO or its licensors and is protected by copyright, trademark, and other intellectual property laws;
  • You may not reproduce, distribute, modify, display, or use any of this content for commercial purposes (e.g., reselling, copying images for another website) without prior written permission from KURO. Personal, non – commercial use (e.g., saving a product image for personal reference) is permitted, provided you do not violate these Terms.

7. Limitation of Liability

10. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of France (excluding conflict of law principles);
  • Any dispute arising out of or related to these Terms, your use of the services, or a purchase from KURO shall first be resolved through good – faith negotiation between you and KURO. If the dispute cannot be resolved through negotiation, you agree to submit the dispute to the competent courts of Angers, France (unless mandatory law requires otherwise).

11. Miscellaneous

  • These Terms constitute the entire agreement between you and KURO with respect to the services and purchases, and supersede all prior or contemporaneous agreements, whether written or oral;
  • If any provision of these Terms is found to be invalid or unenforceable (by a court or other competent authority), the remaining provisions shall remain in full force and effect;
  • KURO’s failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any future enforcement thereof.
